These Terms of Use (“Terms”) govern your use of loveinfocusfilms.com, our pricing estimator and the Love In Focus client portal (together, the “Site”), operated by Justin Calamia, doing business as Love In Focus Films, based in Hollister, California (“Love In Focus,” “we,” “us”). By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. Your wedding agreement comes first
Wedding videography services are provided under a separate written agreement that you review and sign in the portal (the “Agreement”). These Terms cover use of the Site itself. If anything in these Terms conflicts with your signed Agreement, the Agreement controls.
2. Estimates, availability and booking
- Prices shown in the estimator, including travel fees, are estimates based on the information you provide and the pricing in effect at the time. They are not an offer or a guarantee.
- Checking availability or sending an inquiry does not reserve your date. Your date is reserved only once your proposal is confirmed, the Agreement is signed and the retainer is paid.
- Any date “hold” shown in your portal is a courtesy and expires on the date shown.
- We may decline any inquiry, for example because of availability, distance or capacity.
3. Your portal account
- You must be at least 18 years old to create a portal account or book services.
- We sign you in with one-time codes and links sent to your email. You’re responsible for keeping access to your email account secure and for activity in your portal.
- Please give us accurate information and keep it up to date.
- People you invite. You may invite others (such as a partner, family member or planner) to your portal. They’ll see your wedding information according to the role you choose, and you’re responsible for who you invite. You can remove someone at any time.
4. Payments
- Payments are processed securely by Stripe, subject to Stripe’s terms. We never see or store your full card or bank account number.
- Bank transfers (ACH) usually take about 4 business days to clear and are treated as received once cleared. If a payment fails or is reversed, the amount remains due.
- You may pay ahead in any amount or set up a monthly payment plan where offered, as long as your balance is paid by the due date in your Agreement.
- Autopay. If you turn on autopay, you authorize us to charge the payment method you save for your scheduled payments on their due dates, as described when you turn it on. We’ll email you before each automatic charge. You can turn autopay off or change your payment method at any time in your portal; changes apply to charges that haven’t yet been initiated.
- Add-ons. Add-ons you purchase in the portal are charged at the price shown when you buy them and become part of your Agreement.
- Refunds and cancellations are governed by your Agreement.
5. Electronic records and signatures
You agree to receive contracts, receipts, notices and other records electronically — by email and in your portal — and to sign documents electronically. Your electronic signature has the same effect as a handwritten signature. You can download your signed Agreement from your portal at any time, and you may ask us for a paper copy by emailing hello@loveinfocusfilms.com. To access these records you’ll need a current web browser and an email account. You may withdraw your consent to electronic records by contacting us, but some portal features may then be unavailable.
6. Messages and content you share
- You keep ownership of the messages, photos and files you share with us. You give us permission to store, display and use them as needed to provide our services and run the portal.
- Please only upload content you have the right to share, and don’t upload anything unlawful, harmful or that infringes someone else’s rights.
- Messages in your portal are visible to everyone on your wedding according to their role, and to Love In Focus.
7. Acceptable use
When using the Site, please don’t:
- Access another person’s portal or information without permission, or share your sign-in codes or links;
- Interfere with the Site’s security or operation, or attempt to access it by automated means (such as scraping) without permission;
- Use the Site for anything unlawful, fraudulent or abusive, or to send spam.
We may suspend or remove access for anyone who misuses the Site.
8. Our content and your films
The Site — including its design, text, graphics, logos and portfolio films — is owned by Love In Focus or used with permission, and is protected by copyright and other laws. You may view and share Site pages for personal, non-commercial purposes. Your rights to the films we create for you are described in your Agreement.
9. Third-party services
The Site uses or links to services run by others, such as Stripe (payments), YouTube and Vimeo (video players), Google Maps (venue search) and Vidflow (film delivery). We’re not responsible for third-party services, and their own terms and privacy policies apply.
10. Disclaimers
We work hard to keep the Site accurate and available, but it’s provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we don’t guarantee the Site will be uninterrupted or error-free. This section doesn’t limit any commitments made in your Agreement.
11. Limitation of liability
To the fullest extent permitted by law, Love In Focus will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site, and our total liability for any claim relating to the Site (as opposed to our videography services, which are governed by your Agreement) will not exceed one hundred dollars ($100). Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.
12. Indemnity
You agree to indemnify and hold Love In Focus harmless from claims arising from your misuse of the Site or your violation of these Terms, including content you upload, to the extent permitted by law.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in San Benito County, California, unless your Agreement provides otherwise.
14. Changes to these Terms
We may update these Terms from time to time. We’ll post the updated version here with a new date. Continuing to use the Site after an update means you accept the updated Terms. Changes don’t affect an Agreement you’ve already signed.
